Denver Trial Lawyers ® was mentioned once again in the journal Law Week Colorado in the water softener case. After a large verdict in favor of a family who had a water softener incorrectly installed, an insurance dispute has arisen between the installation company and its insurance company. The verdict was well over the insurance policy’s $2 million dollar limit, and the insurance company is now saying that the installer will have to pay the verdict themselves. Law Week Colorado spoke to several plaintiff’s attorneys who believe that, after the insurance company refuses a settlement, forcing the case to trial, they then have a duty to protect the insured. Unfortunately, the family, including the son who was diagnosed with Crohn’s disease as a result of the installer’s error, is left in limbo while the two companies argue about who pays the verdict.
